Simple wills can be a good estate planning tool. They often are a good choice for young couples or individuals who do not have a lot of assets.

A will works best in conjunction with other estate planning techniques. If most of your assets can be transferred though a beneficiary designation or though joint tenancy and you do not have minor children, then a simple will is probably all that you need. The state of California allows the transfer of up to $150,000 without the need for a probate. Assets that are in joint tenancy or have a beneficiary do not count towards the $150,000.

If you own real property and you only have a will, your estate will need to be probated

A will can accomplish all of your estate planning needs. You can do anything with a will that you can do with a living trust. The main disadvantage is that a will requires probate if your estate is over $150,000 or if you own real property.

You can even put a trust in a will that will become effective at your death. This is called an inter vivos trust, and can be used to provide for your children or other beneficiaries after your death. However, if a complex will is needed, it is often better to consider a living trust. A living trust is more flexible and does have the advantage of avoiding probate.
